Relief to Elvish Yadav: Ban on trial court proceedings, notice to UP government and complainant

The Supreme Court, while giving great relief to YouTuber Elvish Yadav, has currently stayed the criminal proceedings related to the snake poison against him. Elvish Yadav challenged the charge sheet and trial process in the case. Hearing this, the Supreme Court has sent a notice to the Uttar Pradesh government and the complainant and sought a reply. Now the case will not be heard in the lower court till the next hearing.

What is the matter?
The Noida police had registered a case accusing some people including Elvish Yadav of using snake poison in the party. It was alleged that he illegally used snakes and poison in a party. The charge sheet was filed after investigation by the Forest Department and the police in this case. Elvish Yadav filed a petition in the Supreme Court saying that he had been accused of wrong and without evidence. They say they are innocent and have been falsely implicated.

Notice issued to UP government and complainant
Justice MM A bench of Sundresh and Justice Joymalya Bagchi issued a notice to the Uttar Pradesh government and complainant Gaurav Gupta on the petition of Elvish Yadav, who challenged the charge sheet against them in the case. The apex court was hearing Yadav’s appeal against the Allahabad High Court order in which his petition was dismissed. The charge sheet has been accused of consuming snake poison for entertainment in rave parties on behalf of others including foreigners.

Noida police arrested in March last year
Elvish Yadav was arrested by the Noida Police in the case in March last year. His lawyer in the case argued in the High Court that in addition to not establishing any reason for the applicant and the co-accused, no snake, intoxicating or psychological substance was recovered from him. The lawyer further said that although the informer is no longer the animal welfare officer, he had lodged an FIR, describing himself as an animal welfare officer. Describing Elvish Yadav as a well-known influential person and a person appearing in several reality shows on television, the lawyer said that his involvement in the FIR has attracted a lot of media.
